The overwhelming image of Brazil is Carnival and Salvador de Bahia undoubtedly hosts the most intense one. Surfers in the mid ‘70’s searching the coast from Salvador found out about Itacaré, lying 300km (188mi) south. It’s the Bahia State capital, set amidst the Atlantic rain forest, where an abundance of juicy, warm-water beachbreaks, reefbreaks and an amazingly long rivermouth right. Early travellers would have come across the surfing godfather "Old Joaquim", who befriended every surfer and told many tales under moonlight before Itacaré became a renowned backpacker town.

The surroundings of Itacaré
Itacaré is surrounded by a vast and dense area of Atlantic Rain Forest that contains rivers, waterfalls, and a variety of endemic flora & fauna species. In fact, the southern region of Bahia retains the most significant portion of Atlantic Rain Forest in all of northeastern Brazil. We truly believe that besides the stunning beaches and consistent surf conditions, nature is the most precious tourist attraction Itacaré has to offer.
Surfing Itacaré
The coastline of Itacaré ranges from flat beaches that extend for miles and miles, to small sheltered beaches surrounded by hills and rainforest. As a result, the region is host to a wide variety of surf spots with different face directions, extensions, and bottom shapes. Many of these spots remain uncrowded most of the time due to their remote location and limited access.
Starting north & working south, here’s what you need to know about the exclusive Itacaré beach & surf region.
Pontal - Pure Power
During Brazilian winter (May to September) when swells and winds turn south, Pontal offers excellent surf conditions for both intermediate and advanced surfers.

The only inhabitants of Pontal are the many rare animals and thousands of coconut palms. The waves on the outer sandbars are large with a slow break, but become fast and hollow on the inside peaks. Pontal is not well suited for beginners for the following reasons:
- Channels to the outside are not easily accessible and are difficult to navigate
- Forceful cross currents are almost always present and at times severe & dangerous rip currents exist
- Getting in and out can be tricky as well as unsafe due to heavy shore breaks

Tips Cross the river paddling, then walk about 300m North to bet to the peaks. There is no infrastructure on the beach, and no shade! Beware of dangerous rip currents.
Boca da Barra - Endless Rights
On big winter days, Boca da Barra provides one of the longest rideable waves in Brazil. An awesome right-hander, it peels down from the open sea for 1,000-2,000 meters, into the middle of Pontal beach.

Just south of Pontal beach is the river mouth break called Boca da Barra. It can be seen from the center of town and accessed with a short 5-10 minute paddle from our lodging. Waves above nine feet are rare in Itacaré, but we have surfed Boca da Barra when swells were at 12 feet and have seen it produce even larger breaks.
But, beware! In order to ride Boca da Barra, you will find yourself far out in the ocean where orientation is difficult and cross currents pull you away from the peak. Violent rip currents can make it a nightmare to get back in. Always check your equipment before you go since losing your board could be a fatal mistake and NEVER GO ALONE!

Corais - Perfect Tubes
Like riding tubes? Then Corais is sure to be your favorite! Whenever there is a solid & clean east swell, this spot provides long, perfect left and right tubes at low tide.

If you head south of the Rio de Contas river mouth (Boca da Barra), you will pass the calm Praia da Concha beachfront and its many restaurants & pousadas (including ours). Just beyond the lighthouse jetty that protects Praia da Concha is Corais (meaning corals).
This spot only starts working with overhead surf and is always a serious peak due to the sharp, underlying rocks and the absence of reef passes, which makes it difficult to paddle in and out. If you’re just starting out here, try the southernmost left-hander called “buraco do barbudo,” and ONLY GO LEFT!

Tips If you don’t dare to use the narrow and inconsistent reef passes, paddle over from the beach breaks South of Corais. Generally crowded when good, but peaceful.
Tiririca - Heavy Waves and Crowds
Praia da Tiririca is home to the local surf scene and provides consistent short, fast, and hollow waves nearly 365 days a year.

Past Corais is Praia Tiririca, which is the most frequented spot in Itacaré due to its central location and year-round consistency. You will find this peak occupied by locals looking for their daily rides.
The waves at Tiririca are short, fast & hollow with cross currents dragging into the rocks on either side. When the surf here gets overhead, only very experienced surfers should consider paddling out here. EasyDrop does not hold surf lessons at Tiririca because the waves are so challenging and the permanent local crowd can be intense.

Prainha - Stunning Beauty & Powerful Surf
Prainha’s right-hander is one of the most spectacular waves in the region. However, the more consistent left side can often provide perfect tubes.

Prainha was rated one of the top ten beaches in Brazil due to its natural beauty, but recent development of private residences & hotels has robbed it of its isolated charm.
The beach is located within a 45-minute walk of town and during the Brazilian summer months (December to February), solid northeastern swells produce perfect tubular left point breaks in the left-hand corner. In the deep winter months, huge south swells and pure southern winds produce a gnarly but awesome right-hander that goes off in the right corner with an easy take off frame and peeling into a heavy shallow tube. When this break is on, you are sure to see some of the most spectacular waves in the region!
However, Prainha is sensitive to wind and the consistency here is spotty. On most days, this peak generates some short, heavy rights and lefts across the span and have a tendency to close out.

Jeribucaçu - An Empty Line Up
The two nice and consistent waves at Jeribucaçu (a right and a left) remain unsurfed throughout most of the year, due to the difficult access (long steep trail) to this beach.

The next surfing beach after Prainha is Jeribucaçu. Since this beach is not within walking distance of town, you will need to travel by car and once you reach the access points, there is an additional 20-30 minute hike in to the beach. Keep in mind that Jeribucaçu has several access points that are quite hidden, so plan to get a guide or go with EasyDrop!
There are two waves at Jeribucaçu, a short and heavy right-hander from the right corner that breaks into the middle of the beach and a longer, but still heavy left-hander from the middle breaking into the right corner of the beach. You’ll find an easy channel on the right, close to the rocks.
For the waves at Jeribucaçu to be up, a 3-4 foot swell is required so the main season here is our winter months. But the bottom is all sand and underlying rocks are well defined causing the wave patterns to remain the same throughout the year. Since this peak is fairly consistent, it is a great alternative to crowded Tiririca for shortboarders.

Engenhoca - Longboarders & Kooks
Engenhoca is the main longboard peak in Itacare thanks to its more mellow and longer peeling waves.

Just south of Jeribucaçu is Engenhoca, another beach with limited access. You will need to drive further on the road toward Ilheus and hike in from the access point for a bout 20 minutes through the rainforest. Again, we highly recommend you use a guide or our experienced EasyDrop staff to reach this spot.
Engenhoca is EasyDrop’s main teaching beach due to the consistent surf and mellow currents, which makes it easy to paddle in and out. The beach is a half enclosed bay and is nicely protected from the northeast wind that is characteristic of our summer months. However, if the swell turns east or southeast the break can become choppy. You’ll find a nice channel on the left side that works perfectly up to double overhead surf!

Itacarezinho - Endless Beach Breaks
Itacarezinho is a 10 km stretch of open beach breaks that can range from mellow to very powerful tubing. This beach also has some reefs you can explore.

The last beach in our region is Itacarezinho, just south of Engenhoca. A hefty entrance fee will grant you drive-up access to the restaurant on the north end of the beach. Or you can access it via a 15-minute walk down a steep road.
The best breaks are found south of the restaurant, and real estate development may limit the road access. If you walk along the beach you’ll eventually reach the legendary left-hand reef break called “Pedra Preta” that is near perfect in summer conditions. But on any day at Itacarezinho when the surf is up and the wind is down, you will find good surf all over!

Pousada Girassol is located on Praia da Concha, one of the most posh neighborhoods in Itacaré and an excellent place for relaxing and swimming. In addition, a short 5-minute walk will bring you to the heart of town and the EasyDrop headquarters where we depart daily to our surf destination.
Pousada Girassol
Pousada Girassol is a friendly, family-run business and EasyDrop has been partnering with them to house our students for the last several years. The proprietors, friendly folks from the central Brazilian state of Minas Gerais, are flower enthusiasts and you’ll often find rare species scattered around the walled garden.
All 12 rooms in Pousada Girassol are spacious, extremely clean and individually decorated and include a private bathroom. For your convenience, each room comes with air conditioning, small refrigerator, TV, and a veranda with hammock.
Each day they serve up a rich, tropical breakfast in an airy outdoor patio and include homemade specialties from Minas Gerais. Since Pousada Girassol is tightly integrated into the EasyDrop concept, breakfast will even be made available on days with early surf sessions.

Praia da Concha
Praia da Concha doesn't offer any surfable waves because the beach is protected by Itacaré's lighthouse and jetty. However, when the south swells start pumping in the winter months (May to September), Praia da Concha becomes the departure point for stunning surfing sessions at Boca da Barra and Praia do Pontal, which are two of the most legendary peaks in the region. A 15-minute paddle will be worth your while, because the waves are among the finest in northeastern Brazil! Both spots can be seen easily from the balconies of Pousada Girassol.
Casarão Verde
To save your budget for the big adventure we recommend staying at Casarão Verde. A beautiful hostel located right in front of the buzzling sea front promenade. You can enjoy your breakfast while watching the palm trees moving in the wind and the fisher boats returning from the night catch. The city center and the EasyDrop headquarter are just a few meters away and some of the world's most beautiful beaches are in walking distance.
The "big green house" is more than just an ordinary hostel. The house is an old heritage building representing the architecture and style back from the cocoa and colonial time early in the twentieth century. Still owned by the fourth generation of the same family it creates a friendly and relaxed atmosphere where people from all over the world meet and share experiences.
The building accommodates dorm as well as private rooms, which are all lovely decorated in a relaxed and clean environment. Every morning a beautiful breakfast is served while you can enjoy the view over the Sea. The friendly staff is always around and can help you to organize your day activities. During the night you can meet fellow travelers at the Hostel bar and play games while you are listing to great music.

Veronica Neves
Qualified professional massage therapist through the Council of Holistic Therapists (CRTH - Sinth-BA 0886/05).
She performs Relaxing oil massage, Bio-dynamic Massage (Reiki) and Ayurvedic massage.
Veronica is an experienced massage therapist and applies massages with great skill and energy, always looking for the best recovery muscle result for surfers.
Carlos Zuqueto
Qualified as a massage therapist, specialized in Japanese Shiatsu pressotherapy.
More than a massage, Shiatsu is a medicine made with thumb pressure on special points of aculputura. Promotes deep harmonization of energy fields bringing physical balance, mental and emotional.
Carlos Zuqueto is also surfer and one of the oldest EasyDrop's surf instructors and he applies Shiatsu always with his characteristic energy and positive mood.
Yoga
Our yoga lessons are scheduled in harmony with all of our surf sessions. They are led by a professional yoga instructor and surfer, and take place in a wooden gazebo set amidst the natural landscape of the Atlantic rain forest.
Yoga is the practice of self-realization and healing through various postures, breathing and meditation techniques. This Vinyasa style of Hatha yoga is a dynamic flow of postures. It develops strength, conditioning, coordination, and breathing, encouraging conscious use of your energy.
Added flexibility, equilibrium, coordination, and bio-consciousness will prove to be of great value while learning new surfing techniques. In addition, the strength and power acquired through yoga are very helpful for paddling through the impact zone and while held underwater by a wave. Yoga practice also promotes physiological, energetic, mental and emotional strength, providing the self-confidence and control necessary to deal with adverse situations in the sea.
Our yoga instructor and surfer, Gui Silva has been traching yoga since 2000. In addition to his bachelor's degree in Physical Education, Gui is also certified as a yoga Instructor and Biogymnastics teacher. In addition, he also holds a Brazilian Surf Council Surf Instructor certification.
Our one-hour sessions take place on Tuesdays and Thursdays, scheduled around our practical and theoretical surf lessons, in a beautiful and calm garden a 5-minute walk from the EasyDrop headquarters.
The yoga sessions are taught in English and Portuguese, with small groups of up to 8 people, and can be adapted for beginners or advanced yogis.
Two “Yoga for Surfers” lessons per week, taught by our professional yoga instructor and surfer Gui. One-hour sessions on Monday, Tuesdays or Friday, scheduled according to our surf lessons and held in the beautiful park of Pousada Ilha Verde (central Itacaré).
Portugese
Learn with us! EasyDrop’s weekly Portuguese Crash Course caters to students who would like to learn simple Portuguese sentences, basic vocabulary and grammar in a very short time frame. The course contents also introduce aspects of Bahian and Brazilian culture.
Daily classes meet for one and a half hours and are held at the EasyDrop headquarters. Our relaxed classroom atmosphere has all the tools you need to learn the native language and students will receive a printed instruction manual. Groups of up to six students gather to practice their Portuguese either before or after our scheduled surf classes, so you can easily participate in both!

Looking for more intense Portuguese lessons?
After an initial six-day period, students can upgrade their classes to more intense & challenging instruction. But even if you choose to stick with our regular crash course, you will eventually be able to understand most day-to-day conversations in Itacaré and express your needs and wishes.
The teacher, Márcia Borba has been teaching Portuguese to foreign corporate executives in São Paulo for five years. In 2002, she moved from São Paulo to Itacaré in order to escape the stress of the big city.

Surf Courses
Practical Classes
The teaching methods we apply in our surf lessons were developed by EasyDrop and are considered to be a global benchmark in surf school structure. By breaking the process down into easy-to-learn steps, we can maximize your ability to learn the fine details of each movement. We focus on each individual step first on land, then in the water. Our knowledge of a variety of approaches to learning proper technique allows us to personalize your education based on individual bio-mechanical characteristics and style.
General surf class setup
Our surf lessons consist of groups of up to 12 students, with EasyDrop providing at least one instructor for every five students. Students are then grouped together based on similar skill levels. Remember that our goal is to maximize your surfing success, so that means if one student’s ability doesn’t match the rest of the class they will still receive individualized instruction from our team at no additional cost.
The entire group will benefit from universal lesson topics such as assessing surf conditions and proper stretching. In addition, EasyDrop’s trademark video review and theoretical analysis are done together daily so that the entire group can be exposed to a wide variety of skill & performance. This also provides a fun & unique experience for students to get to know one another. With this setup, we can meet the needs of all different levels, from beginner to advanced surfers.
Key techniques for beginners
During the first half of our two-week beginner’s course, students learn to master the basic skills.

Intermediate & advanced techniques
For our intermediate & advanced students, we offer individualized training plans that aim to systematically improve technique through specific exercises and personal coaching. These surfers also benefit from the use of our video technology. In addition, select EasyDrop instructors with many years of competitive experience assist advanced students with professional advice and tips.
Theoretical Classes
Theoretical surf classes are held from Monday through Friday at the EasyDrop headquarters located in the historical center of Itacaré. They consist of detailed video feedback as well as the exploration of nine content modules related to technique & safety. These sessions run on a weekly cycle, are accompanied by an EasyDrop surf manual, and last approximately one and a half hours.
An EasyDrop surf instructor facilitates a discussion of the daily video footage and together with the group, identifies correct technique as well as areas for improvement using slow motion and repetitive playback. Being able to watch yourself surf is a fundamental way to translate our instructor’s suggestions. In each session, instructors will also help you set new goals for the following day.

LineUpEXplorers GmbH (hereinafter LUEX), Köln, provides an internet-based intermediary platform for global travel-related products and services. For this purpose LUEX operates a travel information, communication and booking system on the internet. This offers travel-related products, services, and information. These terms and conditions govern the use of the entire LUEX offerings, also in particular the booking of trips, travel components and services. LUEX reserves the right to make provision for supplementary terms and conditions for certain travel-related offerings or destinations. As LUEX acts only as an intermediary, the specific and general terms and conditions of any third party offering a product or service shall also apply additionally. In the event of conflicting conditions, the general terms and conditions of LUEX shall apply preferentially.
The parties to the legal relations shall be designated as "Travellers", with a person who also makes a booking for one or more Travellers designated as a "Group leader". The member of a tour group shall also be designated as a "Group member". "Service provider" designates a company or person that delivers the actual product or service - usually on location at the destination - that LUEX (Intermediary) offers to Travellers.

2. Website
The website constitutes the fundamental information that LUEX provides to Travellers. The offers, representations, data, software, images, illustrations and information are subject to copyright in virtually their entirety. To the extent that the design, photos, selection and manner of composition and preparation have been prepared by LUEX, the rights are held exclusively by LUEX. Large quantities of information, offers and images are delivered by third parties, in particular also by Service providers. This content is also legally protected by copyright, trademark and competition law and may not be copied, transmitted or used in any manner other than within the scope of the website without the prior express written authorisation of LUEX or the rights holder, if applicable.
LUEX shall make every effort to update information and prices at all times. Nevertheless, there may be differences due to the volume of data, information and parameters. Prices and specifications can be found based on the individually prepared offering. The booking confirmation and the price calculated for the Traveller are definitive.
LUEX is unable to monitor or check all information provided, especially links to other websites. LUEX is unable to maintain and update this content. In this respect, LUEX is unable to assume any responsibility.
3. Intermediary services
LUEX facilitates the provision of travel-related products and services by Service providers in the form of travel modules and services. LUEX is not a tour operator and does not deliver, own or control any of the travel-related products and services on offer. The travel-related products and services are delivered directly by the Service provider. The offerings provided by LUEX are intended for natural persons. In this context, the Traveller / Group leader making the booking must be at least 18 years of age. A Group leader aged 18 years or over must book for under-age travel companions. The offerings are primarily intended for Travellers from Germany. In utilising this offering, the Group leader making the booking promises that they are authorised to act on behalf of their travel companions, in particular to arrange travel-related services and to conclude contractual arrangements in the name of the Travellers. The Group leader is liable to LUEX as the joint and several debtor in addition to the individual Travellers for the payment of the travel-related products and services booked. Legally binding declarations received by the Group leader are deemed to have been received by all Travellers in the tour group.
4. Bookings
To the extent that no further commitment periods have been agreed, the following shall apply: By filling in the booking templates and confirming the booking procedure, the Traveller/Group leader commissions LUEX to finalise the intermediated procurement with the Service provider. A confirmation of receipt from LUEX with respect to an order immediately after the Traveller/Group leader has transmitted the data does not constitute a binding confirmation of the intermediated travel-related products and services.
Immediately upon receipt of the booking, LUEX shall assess the availability of all the booked products and services from the Service provider/s. Following this assessment, the Traveller/Group leader shall be issued a booking confirmation. The Traveller/Group leader is obliged to check this confirmation carefully immediately upon receipt. If information appearing on the confirmation or in another document is incorrect or incomplete, the Traveller/Group leader is obliged to inform LUEX immediately - in text form if possible. Alterations at a later point in time can only be considered if LUEX could reasonably be expected to make such changes. Unreasonable alterations are such changes in particular that involve additional costs for LUEX, unless the Traveller/Group leader reimburses these costs.
A binding agreement between the Traveller and the respective Service provider shall only eventuate when the binding booking confirmation has been transmitted to the Traveller/Group leader; the automatic LUEX confirmation of receipt is not a booking confirmation.
The following applies when a Group leader makes a booking for several Travellers: With their booking, the Group leader confirms that they are permitted to legally represent the group members (Travellers) and that the Group leader is permitted to make and receive declarations on behalf of the group members. If travel vouchers are dispatched, they shall be sent solely to the Group leader for the whole tour group. Payments shall be processed exclusively through the Group leader with debt discharging effect.
The contractual obligation of LUEX is limited to the proper intermediation of the booked travel-related products and services. The contractual obligations of LUEX do not include the delivery of the booked product or service.
5. Payments, cancellation charges
LUEX is entitled to demand payment of deposits and outstanding amounts in accordance with the general terms and conditions as well as the terms and conditions of payment of the Service provider of the mediated product or service. Payment shall be collected as instructed by the respective Service provider. It is possible that the method of payment accepted by the Service provider may differ from the standard modes of payment used by LUEX or in Germany generally. The details are to be found in each of the offerings respectively. To the extent that nothing to the contrary has been agreed, the following shall apply:
Following receipt of the payment request, payment of the deposit indicated on the payment request is to be made in a single payment within one week by means of the payment method indicated. The deposit shall be at least 25% of the total price of the travel-related products or services that have been booked. The outstanding amount for the travel-related products or services is to be paid no later than 30 days prior to the commencement of travel as a single payment by means of the payment method indicated without any further request for payment. In the case of tour groups, the Group leader is responsible for ensuring consistent payment processing. The total price of a tour booked at short notice (within 30 days of tour commencement) is due immediately.
If due payments are not made or not made in full and the Traveller/Group leader does not pay after a reminder with a final due date, LUEX or the Service provider are able to withdraw from the particular agreement, unless LUEX or the Service provider is already responsible for a significant flaw, failing or shortcoming at this time. If the Traveller is responsible for the cancellation, LUEX or the Service provider can demand compensation in accordance with the agreed fixed rates for compensation. If nothing else has been stipulated within the offer/travel confirmation, the fixed rate in the event of the Traveller cancelling more than 30 days prior to departure is 25% of the price of the tour. The Traveller/Group leader is entitled to provide evidence of lower costs or costs that did not eventuate, while LUEX is free to calculate and demonstrate substantially higher costs.
LUEX assumes no currency risks. In order to minimise currency risks, LUEX shall exchange the travel payments received into the target currency of the country of the respective Service provider as soon as possible after receipt of payment. In the event of major currency fluctuations, the Traveller/Group leader shall indemnify LUEX against any proven currency exchange losses. Reimbursements shall be made solely by means of bank transfers in the currency of the recipient. Bank fees and charges shall be borne by the Traveller/Group leader.
If the Traveller/Group leader pays by bank transfer, LUEX can only facilitate a smooth booking process if the Traveller/Group leader uses the designated booking ID in the purpose field of the bank transfer which is specified in the request for payment. Otherwise LUEX may not be able to assign the payment to the correct booking. A failure to do that correctly can result in the cancellation of a trip in the worst-case scenario.
If the Traveller wishes to book not as a private individual, but as a business traveller acting on instructions or as a legal representative, this must be noted already during the booking process and cannot be subsequently altered. This can have taxation consequences and should therefore be carefully considered.
The customer shall receive a payment receipt in the form of a booking confirmation from LUEX showing the total price, either paid or to be paid to the Service provider.
6. Alterations, cancellations, reimbursements
In the event that a confirmed booking is modified or cancelled, LUEX is to be contacted as quickly as possible in this matter such that a possible solution can be sought in consultation with the Traveller/Group leader. Additional costs that result for LUEX or the Service provider shall be borne by the Traveller/Group leader, whereby LUEX reserves the right to invoice a minimum fee of €50 for changes demanded solely by the Traveller.
Should there be a modification or cancellation by LUEX / the Service provider, LUEX shall also contact the Traveller/Group leader as soon as possible and seek a possible solution.
LUEX notes explicitly that as an intermediary LUEX cannot assume responsibility for the performance of the Service provider. In particular, LUEX offers individual travel-related products and services to exotic destinations. The Traveller recognises that booking and processing these products and services are more difficult and that a higher degree of flexibility is expected of these than for mass tourism.
7. Complaints and ratings
Should the Traveller be dissatisfied with an aspect of the travel-related product or service received in a particular case and wish to submit a complaint, they are to approach the Service provider or their representative directly at the location during their current stay so that this person can attempt to solve the problem. LUEX recommends notifying the Service provider in text form that documents the shortcomings, if possible with the aid of photos.
If the problem cannot be resolved during the stay, the Service provider must be contacted within 30 days of returning from the trip. The Service provider should then respond to the correspondence according to the applicable laws and regulations. Receipt should be confirmed in 14 days and a full response received within 28 days. If this is not the case, an explanation for the delay should be received from the Service provider.
Should the travel-related product or service not match the description on the LUEX platform, the customer must approach the Service provider or their representative directly at the location during the customer's stay. LUEX shall support customers with respect to their complaint. LUEX is to be informed of the facts involved in the situation as soon as possible in order to be able to assist in finding a solution.
The Service provider is to be contacted immediately in the event of flight or transportation problems. Customers are to check information and the general terms and conditions given to customers via the Service provider before the commencement of travel.
8. Visa, passport and travel regulations
The Traveller/Group leader shall pay attention to the special visa, passport and travel regulations for the Travellers and their country of destination. LUEX makes every effort to inform customers as comprehensively and accurately as possible. To the extent that LUEX draws attention to particular details, this can only be considered as non-binding information. Considering the high number and frequency of possible amendments to regulations, Travellers/Group leaders are requested to contact the relevant embassy/consulate for the particular destination. In this respect LUEX can assume no responsibility whatsoever for any assurance, guarantee, currency or accuracy of the information. The information provided by Travellers’ ministries of foreign affairs are a reliable source with respect to many travel destinations.
It is the sole responsibility of the Traveller/Group leader to ensure that all Travellers are in possession of all requisite travel documents (passport, Visa, etc.) at the commencement of travel and that all Travellers fulfil the health requirements.
9. Insurance
To the extent that it is not expressly offered, insurance cover does not constitute part of the travel-related products and services offered. LUEX recommends that customers take out travel insurance, in particular travel cancellation cost insurance and in certain circumstances overseas travel insurance, including an overseas health cover component. LUEX names a reliable partner offering the relevant insurance policies to its customers at: http://www.luex.com/info/insurances.html.
10. Liability, responsibility
LUEX depends on the information provided to it by the Service providers with respect to the details of the travel-related goods and services. LUEX has only extremely limited opportunities to check such information with respect to their accuracy and completeness. Consequently, LUEX is unable to provide any guarantees or assurances with respect to the completeness, accuracy or currency of such information. The same applies for any other information made available by third parties.
LUEX is not liable for the availability of the travel-related product or service at the time of booking or for the performance of the booked travel-related product or service by the Service provider.
Within the scope of its performance obligations, LUEX is only liable for any losses that may result in the following cases, irrespective of legal grounds: The statutory regulations shall apply with the following restriction: Liability or minor negligence on the part of LUEX or its vicarious agents is excluded, provided that neither an essential contractual obligation was breached nor is there a case of initial incapacity, impossibility or default on the part of LUEX. Otherwise liability is limited to the value of the travel-related products and services booked, in any case however to predictable and typical losses. The exclusions of liability or facilitation shall apply in the same manner to the executive bodies of LUEX, as well as to their vicarious agents.
Travellers and Group leaders shall be liable to LUEX for each and every reservation/booking that is made in bad faith or with deceitful intent or with erroneous or incomplete personal data. The opportunity to book travel-related goods and services may only be utilised in order to make legal bookings as a Traveller or as a Group leader for a third party. At the same time, in utilising the offerings the Group leader guarantees that they are authorised and are permitted to act in the name of fellow travellers. In the event that there is a breach of these guarantee, the Group leader is liable without limitation to LUEX and their respective Service providers for the losses resulting from the aforesaid person’s actions.
In many countries there are safety standards that differ from those generally found in Europe, Australia or the USA. Travelers/Group leaders are strongly encouraged, also in their own interest, to access information once again immediately before commencing travel in accessible sources, such as the internet pages of the Foreign Office, with respect to changes in the travel regulations and safety warnings for the country of destination.
11. Final provisions
Should business terms and conditions or parts of the agreement be or become invalid, the validity of the remaining parts of the agreements shall not be affected.
Amendments or additions to all agreements, including a divergence from these general terms and conditions, are only possible in text form (written, by fax or e-mail). Oral agreements require written confirmation to be valid.
All communication between LUEX and a Traveller/Group leader is to be undertaken by e-mail if possible. The Traveller/Group leader therefore promises to receive and read e-mails and implement the information/instructions from LUEX accordingly. LUEX must be informed immediately of changes in contact details.
All contractual relations between LUEX, its customers and Service providers are subject exclusively to German law - with the exception of the UN Contract for the International Sale of Goods (CISG) convention. Köln shall be the mutually agreed place of jurisdiction for non-German Travellers.
