Despite its North African location, Morocco is very much a part of the European surf trail. Located between 20° and 35° latitude with a NW facing coastline, Morocco has all the key elements for an outstanding surf destination. The Tarhazoute area in the south nestles behind a big cape, which funnels the predominant north winds into an offshore direction. The spots are all easily accessible by road with the waves generally breaking right over flat rock and sand. With balmy winter land temperatures, cheap living and a fascinating cultural diversity, Morocco is a must for the European surf traveller.
Taghazout has enjoyed legendary status for decades, as a place to escape the winter blues and surf the great pointbreaks clustered around the famous Anchor Point. Known as 'Madraba' in Arabic and called 'Ikhflout' in the local Berber tongue, Anchors (or Ankas) has the ability to hold huge size and break down the perfectly angled headland for over a kilometre. The warm, green walls are powerful yet accessible to intermediates and provide a relatively safe environment for less accomplished surfers to improve their pointbreak skills, at least when it is small. Just to the north, past the reefs of Mysteries and La Source is another great, righthand pointbreak called Killers. It is this concentration of quality that has attracted surfers to this mellow fishing town, which is now showing the signs of development and ever increasing numbers of surfers and surf camps. There are more waves in town like Hash Point and Panoramas, then miles of beginner beachbreak running south to Banana Village at Tamrhakht. A few reefs, including a rare left, complete the picture towards Agadir, where there are more local surfers. Winter is the only time to go because the bigger swells are needed to get into the series of headland protected bays that make this area so good. Anchor Point often sleeps from April to October, although Killers will break on much smaller swells. The N/NE winds get bent and funnelled offshore by the coastal ranges, but in summer there are more NW onshore winds to contend with.

The Surf In Morocco...
There is a very good reason why most of the top professional surfers in the world, when visiting Morocco for work and pleasure choose to stay with Moroccan Surf Adventures. With over a decade guiding in this region there is no one who knows this coastline quite like us. We guarantee to source the best surfing conditions for the individual on a given day, time or tides. With the diversity of the Moroccan coastline and localised winds changing regularly the key is knowledge. Denny, Nigel and the guides are passionate surfers and our philosophy has always been to search further afield for pastures new. On average, even with Morocco’s popularity, we surf alone approximately 70% of the time. There is nothing quite like sharing a beach or surf break with just yourself and your friends. The diversity of our coastline offers us seemingly endless selections of sand covered points, reefs and beach breaks.
The immediate stretch of coast (50km either side of Agadir) to where we are situated, is one of the richest, densely saturated areas of world class surf in the world. This mixed with the quality conditions we receive for over 8 months a year means there is always a wave that can be found, whatever your level of surfing ability. Clean lined up swells make even the hard work of beginning surfing fun and easy. On average, even in this crowded day and age, we surf alone approximately 70% of the time. There is nothing quite like sharing a line up with just you and your mates. For various reasons, and not to state the obvious, we cannot disclose where some of these spots are. We can, however, guarantee that if you stay with us there is a very good chance you may end up surfing one!
The climate in Morocco...
The Agadir region of Morocco is famed for its annual temperate climate and consistent weather patterns.
For the Months of November to April it is recommended that you bring some warm clothing for the evenings however the daytime temperature is generally a pleasant 16 to 25 degrees. For the surf you will need a 3mm full length wetsuit and Wetsuit boots can be useful if surfing over rocks or reef. Don't forget your sunscreen. For the months of May to October the weather can be really warm indeed. Daytime temperatures will be 25 to 30 degrees. We would still recommend that you bring some warm clothing for the evenings. Many surfers will be wearing short wetsuits and some even in board shorts during the Moroccan Spring/summer/Autumn. Sunscreen is an absolute necessity
Surf Spots...
Tamri A friendly beach break suitable for all levels, open to all swells. Never goes flat!
Boilers Fast, long right hand point break, very makeable with a great inside barrel section. Is one of our most consistent breaks. It is an intermediate to advanced spot due to the rocks and currents.
Killers Famous sand bottomed right hand point break, speed sections and bowl sections and the odd barrel. This wave has it all, 250m rides are common. Fun inside sections for beginner/intermediate surfers when small. Due to the surrounding hillside the katabatic winds are pretty much offshore 99% of the time, which is perfect as Boilers is a swell magnet.
Anchors Famous sand bottomed right hand point break, speed sections and bowl sections and the odd barrel. Beautiful right hand reef with sand channels, fun & rippable.

Devils Rock Peaky beach right in front of our village. Fun for all levels, enjoy a mint tea after a session at the beach side cafe.

Our bespoke villa was completed in July 2018 and whilst much attention went into the design and building process of Villa Dar al-salam its location was equally as important. Having spend over 20 years in the Agadir region, and witnessed the escalation in the construction industry our main priority was to relocate to a more sustainable and traditional area whilst offering modern, comfortable beachfront accommodation.
Imi Ouaddar is naturally sheltered by two large headlands with a white sandy beach and a stunning backdrop of the Atlas mountains. The area provides surfers with gentle beach-break conditions directly in front of the villa with access to the best point breaks in Morocco only minutes away.
Aside from the surfing you can watch the traditional fishing boats unload their 'catch of the day', sample a coffee or fresh juice from one of the numerous cafe’s or restaurants in the village or indulge in a Moroccan Spa at Paradis Plage.
The Villa
Since our arrival in 2001 finding space and exclusivity around Agadir's fast developing coastline has become more of a challenge however our latest project, Villa Dar al Salam (House of peace) is situated on the stunning beach of Paradise Plage and the village of Imi Ouaddar.
The villa has all ensuite rooms, an infinity swimming pool, games room (pool table ect) a glass dining room for 40 guests and is located on the best beach in the area for beginners and minutes from the points for the ‘guiders'.
The coastline here remains largely untouched and with 5km’s of empty, sandy beach to explore its the perfect place to surf and relax. Minutes from the waters edge we have a purpose built guesthouse for visitors to immerse themselves in our authentic Surf and Yoga package packages.
From the villa you are within touching distance to gentle, protected beach breaks and have direct access to Morocco’s famous point breaks. This makes Villa Dar al Salam a perfect venue for everyone.

Vor Jahrzehnten, als Taghazoute und Tamraght noch verschlafene Dörfer waren, war das Surf Camp von Moroccan Surf Adventures das erste in dieser Region. Als echte Pioniere wissen die Betreiber nicht nur wo die besten Wellen brechen, sondern auch was sonst noch zu einem perfekten Surf Trip dazu gehört. Selbst nach so langer Zeit arbeitet das Team noch immer daran, ihr Angebot ständig zu verbessern, so dass wirklich jeder Surfer hier findet wonach er sucht – egal hie hoch die Ansprüche sowohl im Wasser wie auch außerhalb sind.

Das Camp besteht aus 3 Gebäuden, die alle einen beeindruckenden Ausblick auf das Meer und die Berge haben. Die einzelnen Zimmer beherbergen 1 bis 3 Personen, und die Anzahl der Gäste ist auf 25 begrenzt. Für diejenigen, die ihre Unterkunft mit einem Zimmergenossen teilen, gibt es Trennwände damit deine Privatsphäre gewahrt bleibt. Das Camp ist sauber und schön, und für das Essen alleine würde sich der Aufenthalt schon lohnen. Denny und Nigel, die Besitzer des Camps, sind vor Jahren aus einem anderen Grund nach Marokko gezogen. Die Wellen sind einfach fantastisch und es gibt eine große Vielfalt davon: Righthand Point Breaks, Beach Breaks und sogar ein paar Reef Breaks. Wellen gibt es das ganze Jahr über (und Sonne auch). Im Sommer geht es in der Regel etwas entspannter zu, während im Winter richtig die Post abgeht. Doch auch im Sommer gibt es von Zeit zu Zeit gröβere Wellen, genauso wie du im Winter auch jederzeit auf kleinere Wellen ausweichen kannst. Deine Guides finden dir auf jeden Fall den passenden Surf Break. Nach einem langen Surftag kannst du in einer Hängematte auf der Sonnenterrasse entspannen, oder in freudiger Erwartung einer weiteren tollen Session am nächsten Tag ein kaltes Bier mit alten und neuen Freunden trinken. Auch die täglichen Yoga Sessions, die im Preis des All-Inclusive Pakets mit inbegriffen sind, solltest du dir nicht entgehen lassen.

Yoga
Every morning before breakfast, guests are welcome to join our resident yoga teacher for a yoga session specifically designed for surfers. Whether you’re an absolute beginner or an experienced yogi, you’ll benefit physically and mentally from an hour of yoga focused on preparing you for your day on the surfboard.
Yoga and Surfing
Here at MSA, we’re always looking for ways to make sure our guests get the most out of the amazing swells in this part of Morocco. So when we learned about the huge benefits yoga can have for surfers, we decided to make yoga an integral part of our daily routine.
Many yoga poses involve balance, which is also essential for surfing. The focus is on relaxing your body and breath. This translates directly to the surfboard: rather than freezing into position once you’re up, you stay supple and at ease, ready for anything.
Flexibility - Yoga is a great way of increasing your flexibility, which makes everything from popping up to manoeuvering through a barrel so much easier. Simply put, the more supple your body and muscles, the easier it is for you to move on the board and in the ocean.
Ever come away from a day of surfing with tension in your shoulders, lower back, arms or chest? Yeah. We thought so. Yoga works as both injury prevention and recovery assistance. Our morning sessions are an amazing way to loosen up any tense muscles, and get a good stretch through all of the main muscle groups before you head out into the surf again.
Strength - Yoga utilizes the full spectrum of muscles in your body, building strength and resilience. The result? Loads of extra energy and stamina. Particularly experienced surfers will be aware of the importance of core strength (i.e. strong abdominal and lower back musculature) for popping up, turning smoothly and riding those waves. Yoga also works the deeper abs and muscles that support the spine, making your body strong and ready for a long day on the board.
Breathing is central to yoga and important to surfing. Throughout the yoga sessions we continually return to focus on the breath - this increases your body awareness, increases your lung capacity and helps you relax. All great for optimizing your surfing.
Time to relax.
Yoga reduces stress. You react less to the stuff going on around you. You focus and concentrate more easily. You tune out distractions. You stay in the present, connected with your surroundings and your body. All this helps you to be the best surfer you can, as well as enjoying every moment you’re out in the ocean.
Our sunrise yoga sessions are completely voluntary and we won’t make you feel bad if you decide it’s not for you. But we’re convinced of the benefits yoga brings to every moment you spend on the surfboard. So give our sunrise yoga sessions a shot, and get your day of surfing in Morocco off to the perfect start.
A typical morning session includes:
Warm up.
Sun salutations.
Standing poses to work the legs and improve balance.
Stretches to open up the back, shoulders and chest.
Abdominal and arm strength poses.
Depending on the level of the group, we might also do some inversions.
Each session ends with at least 5 minutes of ‘savasana’ or relaxation. (Everyone likes this bit!)
It is our aim that after each yoga session you will feel energised, focused and ready for a day of surfing. Surfers and non-surfers alike, of all levels, can benefit from these yoga classes; so if you always wanted to try some yoga but never got around to it, this is your opportunity...
Beyond the camp
Agadir
The Agadir region of Morocco is an area that is famed for its favourable, year round climate. The natural shelter, both from the land and coast, offers protection from the storm systems that sweep across northern Morocco and the rest of Europe during the winter months. With a diverse coastline for many kilometres either side of Agadir, the surfing potential is endless, and there are waves to suit all levels of ability. It is also the gateway to the south, where there is seemingly endless coastline to investigate and explore!
The Berber
Morocco's southern aspect is the land of the Berber - a warm, ancient and proud race. Do not be surprised if you are asked to join a berber family for mint tea; it is their deliciously sweet speciality. They may even tempt you to try some tagine, another Moroccan treat for the tastebuds. The mix of natural soft light, hazy hues and landscapes dotted with Argan trees makes this area a mystical, magical place for the visitor. Understandably there is a very strong fishing heritage, and a unique bond with the sea continues today. Witnessing an old fisherman weaving his way through the rocks and swell to land his catch can be a breathtaking and fascinating experience.

Daily Meal
Our long term resident chef Momo has become something of a celebrity amongst our guests, not only for consistently producing exquisite meals day after day, but his uncanny ability in catering to all tastes and dietary requirements.
Cookery Demonstrations
You will also have the opportunity to watch Momo produce the authentic Moroccan meat or vegetarian tagine and cous cous on friday evenings. Along the way, Momo will give you a potted history and insight into the ingredients of this most Moroccan of dishes. His relaxed demonstration is performed out on the terrace over a naked flame so grab a beer and come watch Mo in action. Friday night cookery classes are available to all guests and whilst not obligatory we recommend a look at this lighthearted introduction to Moroccan cooking.
Moroccoan Food
Due to its geography and history, the cuisine of Morocco is a heady mix of Arab, Berber, Moorish, French, Middle Eastern, Mediterranean African, Iberian, and Jewish influences. Dishes frequently feature dried and fresh fruits - apricots, dates, figs, and raisins, to name but a few. Nuts are popular too with pine nuts, almonds, and pistachios showing up in all sorts of dishes. Think of Moroccan food and deliciously aromatic dishes such as tagine immediately come to mind. Spices have been imported to Morocco for thousands of years and common spices include cinnamon, cumin, turmeric, ginger, pepper, paprika, saffron, aniseed, sesame seed and coriander. Popular herbs include coriander leaf, parsley and mint which is used widely in cooking and famously in deliciously sweet Moroccan tea. At Moroccan Surf Adventures we like to give a flavour of real Morocco alongside other world cuisine.

Oats and cereals, Eggs, daily made Moroccan breads, fruit, Yoghurt, jams, Argan oil and Moroccan Amlou (Argan, honey and Almond dip). also provided are fresh juice, coffee and tea.
Lunch
A weekly variety consisting of fresh filled baguettes, rice, pasta and traditional Moroccan salads. A selection of fresh Juice also provided.
Evening Meal
A weekly buffet including vegetarian, lamb, beef and fish Tagine’s, BBQ’s, Cous Cous, Moroccan curries and much more. Every night there is also a selection of salads and vegetable dishes. Evening meals are generally a weekly highlight for most guests!

The surfing lessons package
For your convenience we have a large range of surfboards (hard and soft) and warm, comfortable wetsuits. All the equipment you need is provided and no experience is necessary. It is our aim to teach you the basics principles of surfing and new skills that you will want to practice time and time again.
Surf Lessons Package
Our Surfing Lessons Package is designed to put a smile on your face. You will be tutored in all things surfing by one of our experienced and qualified instructors. We believe in teaching proper form and technique, in a fun and understanding atmosphere, to give you a solid surfing foundation to build upon and take your surfing to the next level. You will also receive a grounding in water safety, ocean awareness, surfing etiquette and wave conditions whilst riding gentle waves in warm Moroccan waters.
If you are a novice or improver surfer, but would like the experience of surfing some different breaks during your stay, our new and improved Surfing Lessons Package is a must. After breakfast, you will be given a quick briefing and some core drills at the camp related to that day's surfing. You will then head out to the selected spot of the day with our instructors for a fantastic day of supervised surf.
For your convenience we have a large range of surfboards (hard and soft) and warm, comfortable wetsuits. All the equipment you need is provided and no experience is necessary. It is our aim to teach you the basic principles of surfing and new skills that you will want to practice time and time again.

Surf & Yoga
We introduced sunrise yoga sessions into our surfing packages in 2012 and this addition has been really well received. Nearly all our guests, from first time yogis to qualified instructors, have joined us on the ocean view terrace preparing mentally and physically for the rigorous day's surfing ahead. Now with the help of our resident yoga teacher we are pleased to oversee our 'Surfing and Yoga Experience' which offers a more detailed daily yoga programme; without the loss of any water time of course!
Morning Vinyãsa flow classes are typically themed with a “peak pose” and how this particular pose compliments your surfing. Evening sessions are rehabilitative; encouraging stretching and opening the body up to a healing process. The second part of the session will focus on mindfulness and relaxation where deeper concepts of yoga will be emphasised (Chakras and Drishti).

Surf Guiding Package
With over 20 years surf guiding in Morocco there is no-one who knows this coastline like us and our team of experienced Moroccan guides. Our local guides are all brought up here and are passionate about the region and its unlimited surf potential.
We have had the pleasure of hosting some of the world's best surfers such as Dane Reynolds, Taj Burrow, Shane Dorian, Dusty Payne, Dave Rastovich and Connor Coffin to name but a few. Clearly you don’t have to be a professional to stay with us, but with the diversity of the Moroccan coastline and ever changing winds, experience is the key to being in the right place at the right time and away from the ever increasing crowds.
For your optimum enjoyment and safety it is important that you select the right guiding program for your ability (intermediate or advanced) so we can focus on getting you great waves during your stay.
Intermediate Guiding
You may be slightly nervous about surfing over rocks or reef however our guides will show you the spots along with the entry and exit points to push your boundaries. Morocco has a large, diverse coastline that provides intermediate surfers with a playground of waves to explore. Please note there is no tuition on this package.
We recommend that you can:
- Paddle into most waves you attempt to catch
- Turn your board frontside and backside
- Understand various wave types, surf etiquette and possess a reasonable level of fitness.
- Our aim is to get you the ride of your life in the quietest spots.
Advanced Guiding
If you are an experienced surfer who is happy and prepared to travel distances to find the best, uncrowded conditions; if you are comfortable riding reefs and point breaks then the advanced guiding package is for you. Feel free to check out films such as Sipping Jet Streams, Modern Collective and Trilogy for waves you could be experiencing. There are also plenty more waves to be discovered.

Explorer
We had been acutely aware of the potential for great surf in the ‘desert regions’ outside of Agadir for many years, having been fortunate to guide many of the world’s elite surfers into The Sahara on film and photo shoots. Without the luxury of internet mapping technology or guide books, finding the best waves was painstakingly slow. But over the years we have gradually discovered and documented some fantastic new surf spots. The hard work has been done and now you have the opportunity to surf perfect, uncrowded waves with just a handful of select friends. Since 2012, the preserve of the privileged few has been available to you on our Explorer 4x4 tours.
Unsurprisingly, since our first trips ran back in October 2012, the Explorer 4x4 tours have been a roaring success.
What to expect
Our Explorer tours are also flexible to suit the conditions. We don't follow a strict daily itinerary but we have built up a tried and tested formula for adapting to the weather, waves, time and tide to ensure you get the most from your adventure. Our Explorer tours are flexible to suit your needs. Some guests like to spend time at the camp recovering from their journeytousandacclimatising- and we have developed a new Extended Explorer package especially for them - whilst others like to depart the moment they touch down in Morocco. One thing’s for sure, once we leave the camp our mission to find uncrowded waves begins...
Departure morning is always full of nervous energy and excitement as we sort ourselves out and load the trucks. Our vehicles of choice for these trips are all 4 X 4, seven-seater, Mitsubishi SUVs - chosen for their sturdiness and ability to handle pretty much anything the wild Moroccan desert terrain can throw at you. We take a maximum of four guests per vehicle to allow for comfortable travel and generally take a trailer for boards and camping equipment. Our kit list is comprehensive, but experience has taught us to travel light to keep the trucks more mobile in what can be extreme driving conditions. At this point, somebody generally tries to bring the kitchen sink along and needs a little persuasion that we'll pick up another one for them on the road..!
Hitting the road
Departure moment arrives. Be prepared for the longingglancesandunmistakablelookofenvy that radiates from the camp terraces from those not coming along. Don’t feel sorry for them. They will have a fantastic week too, and there is always next time. We have literally had to turn down cash offersforalastminuteseat, though! Then it’s a toot of the horn, and a 'see you next week' as thoughts shift to the most taxing decision of the week; what board am Igoingtotoride?!
Our travel plans are guided by a combination of the swell forecasts and forecasted weather conditions. If large swells are forecast for the week we may head northwards to take advantage of theplethoraofhighqualitypointsandprotected breaks. Some of the spots in this area can be a little off-limitstotravellingsurfers. There are some highly-prized gems that are jealously guarded by the local cognoscenti. But over the years, together with our own Moroccan guides, we have built up an excellent rapport with the locals in many of these secret spotsandrespectshownhasopenedthe door to many a memorable session in these waters.
On a moderate swell forecast, we may decide to head south to explore the southern coastal regions. Driving over rough tracks and golden sand, here you find a range of hidden coves, expansive beaches and reef breaks that are very exposed to Atlantic swells. There is always surf and you can look forward to surfing together in turquoise water, hidden from view by golden cliffs and no one else around. Expect sand dunes, unique rock formations, camel trains and ample opportunity to surf 'never surfed' waves. You may even discover a new wave here that you can name yourself, like some of our other guests!
Camping under the stars
Our selected path dictates our choice of accommodation over the course of the week. Over the years we have stayed in a mixture of hotels, Moroccan homesteads or Riads, but staying in the tents is always thefirmfavourite. Camping under the desert stars is an experience like no other.
Once we locate a good spot, we position our camp as close to the sea as we can, generally using the backdrop of sand dunes or cliffs for protection from the wind.
Early evenings are spectacular with everything becoming lit by an orange desert glow. This part of Morocco is frequently blessed with clear, cool, starry nights that, coupled with a roaring fire, make for an unforgettable experience. A typical evening will be spent, gathered around a campfire, tucking into one of Dahman’s exquisite fish or vegetarian tagines, a glass of Moroccan wine in hand and the sound of happy banter and crashing waves in your ears. On manyanightwewill find ourselves joined by a local herdsman, with orwithoutcamel, or a fisherman who brings over a musical instrument for evening entertainment or challenges us to a game of beach soccer on the sand. After all the excitement we finally turn in for the night. Provided you have placed your tent on flat ground and don't roll out during the night (it has happened!) you wake at first light as the sun is rising, unzip your tent and are greeted by waves. It is amazing and a lasting memory for all our Explorer guests. Then it is a race to be first into the sea and riding waves!

The desert king
Or should that read dessert?! Taking care of our vital catering andtravellingrequirements over the weekisDahman. He is the younger brother of Momo, our resident chef at the camp, and the skills definitely appear to run in the family! Dahman has quickly earned our admiration as the king of desert cuisine with his innate ability to conjure up deliciously fresh, authentic Moroccan dishes in the most out of the way environments.
Breakfasts usually consist of fresh Moroccan bread, eggs, cereal, tea, coffee and fruit juice. Lunches are made up of fresh - filled baguettes and rice or pasta salad to quell the midday surfing hunger. Dinners come in the form of rich Moroccan tagines of fish, lamb, beef or even camel; sizzling barbecues and a variety of salads. (As with the surf camp, vegetarians are happily catered for, just let us know in advance.)
Dahman also shares his big brother's people skills and nothing seems to be too much trouble for him. When you need a morning pick me up, Dahman is there fixing you that extra cup of coffee. He’ll find you a telephone card to call home one minute and then the next he’ll be on top of the trucks tying a huge stack of boards to the racks, ready to head to the next epic spot.
Surf guides and MSA owners Denny and Nige are also permanent fixtures on the trips. They make sure that things run smoothly and everyone is happy and bring their own unique blend of experience and knowledge of the area to share. They represent the drive to find new places and the infectious joy of being out on the road. Come and share the experience.

LineUpEXplorers GmbH (hereinafter LUEX), Köln, provides an internet-based intermediary platform for global travel-related products and services. For this purpose LUEX operates a travel information, communication and booking system on the internet. This offers travel-related products, services, and information. These terms and conditions govern the use of the entire LUEX offerings, also in particular the booking of trips, travel components and services. LUEX reserves the right to make provision for supplementary terms and conditions for certain travel-related offerings or destinations. As LUEX acts only as an intermediary, the specific and general terms and conditions of any third party offering a product or service shall also apply additionally. In the event of conflicting conditions, the general terms and conditions of LUEX shall apply preferentially.
The parties to the legal relations shall be designated as "Travellers", with a person who also makes a booking for one or more Travellers designated as a "Group leader". The member of a tour group shall also be designated as a "Group member". "Service provider" designates a company or person that delivers the actual product or service - usually on location at the destination - that LUEX (Intermediary) offers to Travellers.

2. Website
The website constitutes the fundamental information that LUEX provides to Travellers. The offers, representations, data, software, images, illustrations and information are subject to copyright in virtually their entirety. To the extent that the design, photos, selection and manner of composition and preparation have been prepared by LUEX, the rights are held exclusively by LUEX. Large quantities of information, offers and images are delivered by third parties, in particular also by Service providers. This content is also legally protected by copyright, trademark and competition law and may not be copied, transmitted or used in any manner other than within the scope of the website without the prior express written authorisation of LUEX or the rights holder, if applicable.
LUEX shall make every effort to update information and prices at all times. Nevertheless, there may be differences due to the volume of data, information and parameters. Prices and specifications can be found based on the individually prepared offering. The booking confirmation and the price calculated for the Traveller are definitive.
LUEX is unable to monitor or check all information provided, especially links to other websites. LUEX is unable to maintain and update this content. In this respect, LUEX is unable to assume any responsibility.
3. Intermediary services
LUEX facilitates the provision of travel-related products and services by Service providers in the form of travel modules and services. LUEX is not a tour operator and does not deliver, own or control any of the travel-related products and services on offer. The travel-related products and services are delivered directly by the Service provider. The offerings provided by LUEX are intended for natural persons. In this context, the Traveller / Group leader making the booking must be at least 18 years of age. A Group leader aged 18 years or over must book for under-age travel companions. The offerings are primarily intended for Travellers from Germany. In utilising this offering, the Group leader making the booking promises that they are authorised to act on behalf of their travel companions, in particular to arrange travel-related services and to conclude contractual arrangements in the name of the Travellers. The Group leader is liable to LUEX as the joint and several debtor in addition to the individual Travellers for the payment of the travel-related products and services booked. Legally binding declarations received by the Group leader are deemed to have been received by all Travellers in the tour group.
4. Bookings
To the extent that no further commitment periods have been agreed, the following shall apply: By filling in the booking templates and confirming the booking procedure, the Traveller/Group leader commissions LUEX to finalise the intermediated procurement with the Service provider. A confirmation of receipt from LUEX with respect to an order immediately after the Traveller/Group leader has transmitted the data does not constitute a binding confirmation of the intermediated travel-related products and services.
Immediately upon receipt of the booking, LUEX shall assess the availability of all the booked products and services from the Service provider/s. Following this assessment, the Traveller/Group leader shall be issued a booking confirmation. The Traveller/Group leader is obliged to check this confirmation carefully immediately upon receipt. If information appearing on the confirmation or in another document is incorrect or incomplete, the Traveller/Group leader is obliged to inform LUEX immediately - in text form if possible. Alterations at a later point in time can only be considered if LUEX could reasonably be expected to make such changes. Unreasonable alterations are such changes in particular that involve additional costs for LUEX, unless the Traveller/Group leader reimburses these costs.
A binding agreement between the Traveller and the respective Service provider shall only eventuate when the binding booking confirmation has been transmitted to the Traveller/Group leader; the automatic LUEX confirmation of receipt is not a booking confirmation.
The following applies when a Group leader makes a booking for several Travellers: With their booking, the Group leader confirms that they are permitted to legally represent the group members (Travellers) and that the Group leader is permitted to make and receive declarations on behalf of the group members. If travel vouchers are dispatched, they shall be sent solely to the Group leader for the whole tour group. Payments shall be processed exclusively through the Group leader with debt discharging effect.
The contractual obligation of LUEX is limited to the proper intermediation of the booked travel-related products and services. The contractual obligations of LUEX do not include the delivery of the booked product or service.
5. Payments, cancellation charges
LUEX is entitled to demand payment of deposits and outstanding amounts in accordance with the general terms and conditions as well as the terms and conditions of payment of the Service provider of the mediated product or service. Payment shall be collected as instructed by the respective Service provider. It is possible that the method of payment accepted by the Service provider may differ from the standard modes of payment used by LUEX or in Germany generally. The details are to be found in each of the offerings respectively. To the extent that nothing to the contrary has been agreed, the following shall apply:
Following receipt of the payment request, payment of the deposit indicated on the payment request is to be made in a single payment within one week by means of the payment method indicated. The deposit shall be at least 25% of the total price of the travel-related products or services that have been booked. The outstanding amount for the travel-related products or services is to be paid no later than 30 days prior to the commencement of travel as a single payment by means of the payment method indicated without any further request for payment. In the case of tour groups, the Group leader is responsible for ensuring consistent payment processing. The total price of a tour booked at short notice (within 30 days of tour commencement) is due immediately.
If due payments are not made or not made in full and the Traveller/Group leader does not pay after a reminder with a final due date, LUEX or the Service provider are able to withdraw from the particular agreement, unless LUEX or the Service provider is already responsible for a significant flaw, failing or shortcoming at this time. If the Traveller is responsible for the cancellation, LUEX or the Service provider can demand compensation in accordance with the agreed fixed rates for compensation. If nothing else has been stipulated within the offer/travel confirmation, the fixed rate in the event of the Traveller cancelling more than 30 days prior to departure is 25% of the price of the tour. The Traveller/Group leader is entitled to provide evidence of lower costs or costs that did not eventuate, while LUEX is free to calculate and demonstrate substantially higher costs.
LUEX assumes no currency risks. In order to minimise currency risks, LUEX shall exchange the travel payments received into the target currency of the country of the respective Service provider as soon as possible after receipt of payment. In the event of major currency fluctuations, the Traveller/Group leader shall indemnify LUEX against any proven currency exchange losses. Reimbursements shall be made solely by means of bank transfers in the currency of the recipient. Bank fees and charges shall be borne by the Traveller/Group leader.
If the Traveller/Group leader pays by bank transfer, LUEX can only facilitate a smooth booking process if the Traveller/Group leader uses the designated booking ID in the purpose field of the bank transfer which is specified in the request for payment. Otherwise LUEX may not be able to assign the payment to the correct booking. A failure to do that correctly can result in the cancellation of a trip in the worst-case scenario.
If the Traveller wishes to book not as a private individual, but as a business traveller acting on instructions or as a legal representative, this must be noted already during the booking process and cannot be subsequently altered. This can have taxation consequences and should therefore be carefully considered.
The customer shall receive a payment receipt in the form of a booking confirmation from LUEX showing the total price, either paid or to be paid to the Service provider.
6. Alterations, cancellations, reimbursements
In the event that a confirmed booking is modified or cancelled, LUEX is to be contacted as quickly as possible in this matter such that a possible solution can be sought in consultation with the Traveller/Group leader. Additional costs that result for LUEX or the Service provider shall be borne by the Traveller/Group leader, whereby LUEX reserves the right to invoice a minimum fee of €50 for changes demanded solely by the Traveller.
Should there be a modification or cancellation by LUEX / the Service provider, LUEX shall also contact the Traveller/Group leader as soon as possible and seek a possible solution.
LUEX notes explicitly that as an intermediary LUEX cannot assume responsibility for the performance of the Service provider. In particular, LUEX offers individual travel-related products and services to exotic destinations. The Traveller recognises that booking and processing these products and services are more difficult and that a higher degree of flexibility is expected of these than for mass tourism.
7. Complaints and ratings
Should the Traveller be dissatisfied with an aspect of the travel-related product or service received in a particular case and wish to submit a complaint, they are to approach the Service provider or their representative directly at the location during their current stay so that this person can attempt to solve the problem. LUEX recommends notifying the Service provider in text form that documents the shortcomings, if possible with the aid of photos.
If the problem cannot be resolved during the stay, the Service provider must be contacted within 30 days of returning from the trip. The Service provider should then respond to the correspondence according to the applicable laws and regulations. Receipt should be confirmed in 14 days and a full response received within 28 days. If this is not the case, an explanation for the delay should be received from the Service provider.
Should the travel-related product or service not match the description on the LUEX platform, the customer must approach the Service provider or their representative directly at the location during the customer's stay. LUEX shall support customers with respect to their complaint. LUEX is to be informed of the facts involved in the situation as soon as possible in order to be able to assist in finding a solution.
The Service provider is to be contacted immediately in the event of flight or transportation problems. Customers are to check information and the general terms and conditions given to customers via the Service provider before the commencement of travel.
8. Visa, passport and travel regulations
The Traveller/Group leader shall pay attention to the special visa, passport and travel regulations for the Travellers and their country of destination. LUEX makes every effort to inform customers as comprehensively and accurately as possible. To the extent that LUEX draws attention to particular details, this can only be considered as non-binding information. Considering the high number and frequency of possible amendments to regulations, Travellers/Group leaders are requested to contact the relevant embassy/consulate for the particular destination. In this respect LUEX can assume no responsibility whatsoever for any assurance, guarantee, currency or accuracy of the information. The information provided by Travellers’ ministries of foreign affairs are a reliable source with respect to many travel destinations.
It is the sole responsibility of the Traveller/Group leader to ensure that all Travellers are in possession of all requisite travel documents (passport, Visa, etc.) at the commencement of travel and that all Travellers fulfil the health requirements.
9. Insurance
To the extent that it is not expressly offered, insurance cover does not constitute part of the travel-related products and services offered. LUEX recommends that customers take out travel insurance, in particular travel cancellation cost insurance and in certain circumstances overseas travel insurance, including an overseas health cover component. 10. Liability, responsibility
LUEX depends on the information provided to it by the Service providers with respect to the details of the travel-related goods and services. LUEX has only extremely limited opportunities to check such information with respect to their accuracy and completeness. Consequently, LUEX is unable to provide any guarantees or assurances with respect to the completeness, accuracy or currency of such information. The same applies for any other information made available by third parties.
LUEX is not liable for the availability of the travel-related product or service at the time of booking or for the performance of the booked travel-related product or service by the Service provider.
Within the scope of its performance obligations, LUEX is only liable for any losses that may result in the following cases, irrespective of legal grounds: The statutory regulations shall apply with the following restriction: Liability or minor negligence on the part of LUEX or its vicarious agents is excluded, provided that neither an essential contractual obligation was breached nor is there a case of initial incapacity, impossibility or default on the part of LUEX. Otherwise liability is limited to the value of the travel-related products and services booked, in any case however to predictable and typical losses. The exclusions of liability or facilitation shall apply in the same manner to the executive bodies of LUEX, as well as to their vicarious agents.
Travellers and Group leaders shall be liable to LUEX for each and every reservation/booking that is made in bad faith or with deceitful intent or with erroneous or incomplete personal data. The opportunity to book travel-related goods and services may only be utilised in order to make legal bookings as a Traveller or as a Group leader for a third party. At the same time, in utilising the offerings the Group leader guarantees that they are authorised and are permitted to act in the name of fellow travellers. In the event that there is a breach of these guarantee, the Group leader is liable without limitation to LUEX and their respective Service providers for the losses resulting from the aforesaid person’s actions.
In many countries there are safety standards that differ from those generally found in Europe, Australia or the USA. Travelers/Group leaders are strongly encouraged, also in their own interest, to access information once again immediately before commencing travel in accessible sources, such as the internet pages of the Foreign Office, with respect to changes in the travel regulations and safety warnings for the country of destination.
11. Final provisions
Should business terms and conditions or parts of the agreement be or become invalid, the validity of the remaining parts of the agreements shall not be affected.
Amendments or additions to all agreements, including a divergence from these general terms and conditions, are only possible in text form (written, by fax or e-mail). Oral agreements require written confirmation to be valid.
All communication between LUEX and a Traveller/Group leader is to be undertaken by e-mail if possible. The Traveller/Group leader therefore promises to receive and read e-mails and implement the information/instructions from LUEX accordingly. LUEX must be informed immediately of changes in contact details.
All contractual relations between LUEX, its customers and Service providers are subject exclusively to German law - with the exception of the UN Contract for the International Sale of Goods (CISG) convention. Köln shall be the mutually agreed place of jurisdiction for non-German Travellers.
